Over the past couple of years I have noticed questions on the legality of Lolicon and Shotacon. From what I know it seems to be legal in my country. But is that right? Should these media be legal or illegal?

Personally I think that they should be allowed. Nobody is actually harmed in the making of these. The common reasoning I see against it is that it will drive people to attack children, which to me seems very similar to the faulty reasoning that video games cause violence.

Free speech... The government has no right to regulate what people do artistically... At least that's how I feel about it as an American. I don't know how other countries feel.

Either way the constitution in America will prevent any laws against it.

Placing restrictions upon works of fiction, be it art or literature, is a route no civilised society should ever go down.

Methinks Amaretti just pwned this thread.

If no one was harmed in the making of it, then it seems far better to me for people to have a medium to express whatever they're horny about as an alternative to acting out their fantasies if they should involve committing crimes against others.

Amaretti and Distracted finished this debate by the third post. If you are going to censor something like that then you might as well crack down on things that are worse. It is part of freedom of speech and should not be done away with.

i don't have problems with lolicon in general. If that's one general preference then so be it. Drawings and works of fiction shouldn't be censored because there's no actual link between thought and actions; to make that assumption is irresponsible and violates one's freedom.

Funny you should say. This feels alot like Soviet Russia when Stalin became dictator. Limiting the freedom of speech, literature, art, etc., and this, in so many ways, is like that.

It should be legal, for there is no actual child that is being sexually assaulted or raped. Whoever finds it illegal should be smacked with a board with a nail in it.

not to mention that giving people they're images may help them from going out into the street stealing actual children...

They'll appear soon enough, with their twelve bars of red rep and their bible verses, but most of us here support freedom of artistic expression.

We're on an anime forum afterall.

Actually, lolicon is illegal in America. But they only use that law in order to rack up the charges against pedophiles, not people who don't have histories of being sexual deviants.

No, it isn't. In fact he's saying the exact opposite, that perhaps release through fantasy can help prevent things like rape and violence by providing a release to at-risk people.

It's the complete flipside of the usual conservative argument, and one which has more studied merit.

I know, I've been here since the debate forums inception (in fact I was one of the people clamoring for its existence), I was just curious if I had missed any of them when reading through the thread.

No one here is defending that, we're defending creative freedom. The idea that you can draw whatever you want. You can't stop people from creating pictures.

no. it isnt. any judge that says otherwise should be fired. it is protected under the 1st ammendment. Actual CP, as in pictures of underaged people, is highly illegal.

it really comes down to what the judge thinks at the time. few people are willing to challenge such rulings however, do to the danger of being labeled as pedophiles, despite the illegality of prison time for possesing said lolicon.

in the end, they're just drawings.

I'm defending the right to portray fictitious children in fictitious sexual acts on the grounds that it is fictitious and therefore protected under freedom of speech. Child pornography is not child pornography without an actual child. An animated representation of a child is not a child.

One would be going to jail, should a man of the law want to charge one with possession of loli material. Of course, there could always be a court challenge to the law, but that could take a very long time to resolve. And lives could be ruined regardless.

Interestingly, John McCain introduced a proposed law on the matter.

I would totally have my defense lawyer use the "This is not a pipe" analogy.

If I had to choose between Lolicon and Shotacon, it would be Shotacon. But that's not the point...

It is fictitious. Everyone has a right to draw what they want. No one should ever restrict you like that. Just go back and Amaretti's and Distracted's posts. They are both right.

By the way, love the pipe analogy!

Ok there drawings of children. They aren't real children! Hence there is nothing to go on as you can't rape a drawing...........well you could but that'd just be fucked up to do...

    They fail.
